Online Statements & E-Sign Agreement/Disclosure
Introduction
This Paperless Disclosure/Notice E-Sign Agreement and Disclosure (hereinafter referred to as "disclosure") applies to all eligible accounts for which you, during enrollment, elect to receive statements/notices online and/or each account you have with us with which you elect to receive paperless with e-mail notification (hereinafter referred to as "accounts"). In this disclosure, “you" and "your" refer to the account holder, joint account holder or authorized user of the account holders account(s). "We", "us" and "bank" refer to The Bank of Delmarva and/or Liberty Bell Bank, A Division of The Bank of Delmarva. "Communication" means any account periodic statement or notice.
Scope of Communications to be provided in Electronic Form
When you elect to receive paperless notices/statements, you agree that we may provide you with any communications in electronic format, and that we may discontinue sending paper Communications to you, unless and until you withdraw your consent as described below. Your consent to receive electronic communications and transactions includes, but is not limited to:
- Most notices associated with eligible accounts
- Periodic Checking, Savings, and CD Statements
Method of Providing Communications in Electronic Format
Whenever any periodic statement or notice for an eligible account is made available to you at the website, we will send to the most recent e-mail address you have provided to us a notice that the periodic statement, notice is available. The periodic statement (18 months) notice (18 months) will be available to you at the website, as long as you have access to our online banking service. We recommend that you print and/or save copies of your periodic statements or notices as they become available. Except when applicable law requires otherwise, the notice we send to your most recent e-mail address will be the only notice to you about the availability of the periodic statement or notice at the website. You acknowledge that the notice will constitute delivery of the periodic statement or notice, whether or not you view or print such statement or notice.
How to Withdraw Consent
You may withdraw your consent to receive Communications in electronic format for your accounts by visiting www.bankofdelmarva.com or www.libertybellbank.com, logging on to Online Banking Access; Hover over Additional Services and click on Integrated Online Statements; remove the checkmark from the box beside "notify me". At our discretion, we may treat an invalid e-mail address, or the subsequent malfunction of a previously valid e-mail address, as a withdrawal of your consent to receive electronic Communications. After three (3) invalid e-mail attempts, we may withdrawal your consent to receive electronic communications and resume sending paper communications to you. We will not impose any fees to process the withdrawal of your consent to receive electronic Communications. Any withdrawal of your consent to receive electronic Communications will be effective only after we have a reasonable period of time to process your request.
How to Update your Records
It is your responsibility to provide us with accurate, current and complete e-mail address, contact, and other information related to this disclosure and to your accounts, and to maintain and update promptly any changes in this information. You can update your e-mail address via online banking after logging in by clicking on “My Settings”, then clicking “Edit” next to primary Email. After entering your new email address and current password, click “save”; hover over additional services and click on “integrated online statements” to verify your Email Address was successfully updated. If you should have any problems, please contact us by phone at(410) 548-7892, (888) 285-7826 or (800) 787-4542 and we will assist you in updating your personal information.
Hardware and Software Requirements
In order to access, view and retain electronic Communications that we make available to you, you must have a personal computer with Internet access. The minimum system requirements are:
- Web browser software that supports 128-bit security encryption
- Adobe Acrobat Reader 4.0 or higher
- Sufficient electronic storage capacity on your computer’s hard drive or other data storage unit
- Cookies and java enabled to access our secure site
- Customer will be notified of any material change in hardware or software requirements and will be provided with the new requirements
Paper Communications
All Communications in either electronic or paper format from us to you will be considered "in writing". We will not send you a copy of any Communication unless you request it or we otherwise deem it appropriate to do so. You can obtain a paper copy of an electronic Communication by printing it yourself or requesting that we mail you a paper copy by visiting www.bankofdelmarva.com or www.libertybellbank.com, clicking on "Contact Us", then clicking "Customer Service" and sending us an email stating your request or by contacting us by phone at (410) 548-7892, (888) 285-7826 or (800) 787-4542. We may charge you a reasonable fee for the delivery of paper copies of any communication provided to you electronically pursuant to this authorization. We reserve the right, but assume no obligation, to provide a paper copy of any Communication that you have authorized us to provide electronically. You should print or download for your records, a copy of all notices, statements, this disclosure, your initial authorization to receive electronic communications and any changes to that authorization, and any other communications that are important to you.
Preservation of Consumer Protections
Nothing in this agreement affects the content or timing of any disclosure or other record required to be provided or made available to any consumer under any statute, regulation or other rule of law.
Termination/Changes
We reserve the right, at our discretion, to discontinue the provision of your electronic Communications, or to terminate or change the terms and conditions on which we provide electronic Communications. We will provide you with notice of any such termination or change as required by law.
